The Cur8 Group Corp and its affiliates (“CreateBase,” “Company,” “we,” “us,” or “our”) are committed to protecting your privacy while operating our platform for music-catalog diligence and valuation and for royalty collection. CreateBase serves institutional clients — funds, publishers, advisors, and counsel — as well as artists, managers, and other creators. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you access our website, software platform, mobile applications, or otherwise interact with our services (collectively, the “Services”).
By using our Services, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy, our Terms of Service, and our End User License Agreement. If you do not agree with these terms, you must discontinue use of the Services immediately.
1. Information We Collect
1.1 Information You Provide Directly
Account and Profile Information: Name, email address, username, password, billing address, phone number, organization or entity details, professional credentials, role (e.g., fund, publisher, advisor, counsel, artist, or manager), and any profile information you choose to provide.
Payment and Financial Information: Credit card details, bank account information, tax identification numbers, and payment preferences, processed through secure third-party payment processors who maintain PCI DSS compliance.
Uploaded Catalog Data and Diligence Materials: Documents and data you submit for analysis, including royalty statements, contracts and agreements, ownership and splits metadata, chain-of-title documentation, and links to digital service providers (“DSP links”). These materials may contain personal information about you and about third parties — for example, co-writers, producers, counterparties, heirs, or other rightsholders named in your documents. By submitting such materials, you represent and warrant that you have the authority and any necessary consents to provide them to us, and you authorize us to process them to deliver the Services. We process this third-party personal information solely as a service provider acting on your instructions to produce the diligence and valuation outputs you request.
Royalty Platform Access Information: Login credentials, account numbers, security questions, access tokens, and other authentication information for third-party royalty platforms (performing rights organizations, distributors, streaming services) that you authorize us to access on your behalf as your authorized agent under our EULA and Letters of Direction.
Identity Verification Information: For identity verification and compliance purposes, we may collect government-issued identification documents (driver's license, passport, etc.), Social Security numbers, date of birth, and other identifying information through our third-party identity verification provider, Persona Identities, Inc.
Content and Intellectual Property: All music, audio files, compositions, lyrics, metadata (including song titles, writer credits, ISRCs, ISWCs, publisher information, splits, and registration data), artwork, biographical information, and related intellectual property you upload, create, or submit through our platform.
Communications: Messages, feedback, support requests, and any other communications you send to us or through our platform.
1.2 Information We Collect Automatically
Usage Analytics: Detailed interaction data including pages accessed, features used, time spent, click patterns, search queries, and user journey analytics.
Technical Information: IP address, browser type and version, device identifiers, operating system, screen resolution, time zone, referring URLs, and mobile network information.
Performance Data: System performance metrics, error logs, crash reports, and diagnostic information necessary for platform optimization.
Location Data: General geographic location derived from IP address and, with your explicit consent, precise location from mobile devices.
1.3 Mobile App Specific Data
Device Permissions: Our mobile app may request access to:
- Camera: For profile photos and content creation (with your permission)
- Microphone: For audio recording and voice features (with your permission)

Business Partners: Information from record labels, publishers, distributors, collection societies, and other industry partners as necessary for diligence, valuation, rights verification, and royalty collection.
2. How We Use Your Information
2.1 Platform Operations and Services

- Deliver core platform functionality and features
- Ingest, organize, and analyze uploaded catalog data to produce diligence and valuation outputs
- Facilitate rights management and royalty collection
2.2 Catalog Diligence and Valuation
Where you submit catalog data for analysis, we process it to deliver our diligence and valuation Services, including:
- Automated rights check: verifying ownership, splits, and chain-of-title across your uploaded documents and DSP links
- Chain-of-title construction: assembling the sequence of ownership and transfers reflected in your materials
- Data-quality scoring: assessing completeness, consistency, and reliability of the underlying data
- Risk-clause register: identifying and cataloging contractual provisions that may affect value or rights
- Revenue-at-risk and confidence scoring: estimating exposure and our confidence in the outputs
- Discounted cash flow (DCF) valuation: modeling the projected value of the catalog
2.3 Platform Improvement and Development
- Analyze usage patterns to enhance user experience
- Develop new features and functionality
- Improve platform security and performance
- Conduct quality assurance and testing
2.4 Communications and Marketing
- Send transactional notifications and service updates
- Provide important account and security information
- Deliver promotional content and industry updates (with your consent)
- Facilitate community features and networking opportunities
2.5 Legal and Business Operations
- Enforce our Terms of Service and other agreements

2.7 AI and Automated Processing
Our Services include automated processing and AI-powered “skills” that analyze the documents and data you upload to produce the diligence and valuation outputs described in Section 2.2. This includes an automated rights check and AI models that read royalty statements, contracts, ownership and splits metadata, and related materials in order to extract, classify, and assess the information they contain. We may also use commercially available AI services for operational purposes such as customer support, fraud detection, platform optimization, and content moderation.
We rely on third-party AI subprocessors, including OpenAI and Anthropic, to perform this analysis. These providers process your data only to return results to us for delivery to you. Subject to the limited operational exceptions described below:
- Your uploads, creative content, and personal data are never used to train, fine-tune, or improve any AI model, whether ours or a vendor's
- AI subprocessors process your data solely to provide the immediate Services and do not retain it for their own purposes
- We contract with AI vendors on enterprise or zero-retention terms that prohibit training on, and limit retention of, your data
Important: The distinction is simple — we USE AI models to analyze your uploads so we can give you results; we do not let your data be used to TRAIN those models. For details on how specific AI providers handle data, see Section 10.1.
3. Information Sharing and Disclosure
We do not sell your personal information. We may share information only in the following limited circumstances:

If you are an individual (such as a co-writer or counterparty) whose personal information appears in materials uploaded by one of our clients, we generally process that information as a service provider or processor acting on that client's instructions. In most cases the appropriate first point of contact is the client who uploaded the materials, as they determine the purposes of the processing. You may nonetheless contact us at legal@createbase.com and we will assist or route your request to the relevant client as appropriate and as required by law.
6.5 Exercising Your Rights
To exercise these rights, contact us at legal@createbase.com. We will respond within 30 days and may require identity verification to protect your information.
7. Data Retention
We retain your information for specific periods based on data type and purpose:
- Account Data: Retained for 3 years after account closure for legal and business purposes
- Uploaded Catalog Data and Diligence Materials: Retained for the duration of your engagement and for 7 years thereafter to support audit, regulatory, and dispute-resolution requirements, unless you request earlier deletion and we are not required to retain the materials by law or contract
- Diligence and Valuation Outputs: Retained for 7 years to support audit trails, reproducibility, and dispute resolution
- Creative Content and Metadata: Retained for 7 years after account closure to support ongoing rights management, royalty collection, and audit requirements. May be retained longer if required by law, ongoing royalty claims, or unresolved disputes. You may request earlier deletion subject to our legal and contractual obligations.
- Financial Records: Retained for 7 years as required by tax and accounting regulations
- Usage Analytics: Aggregated data retained for 2 years, individual usage data for 1 year
- Support Communications: Retained for 3 years for quality assurance and legal purposes
- Marketing Data: Retained until consent is withdrawn or 2 years of inactivity
- Royalty Data: Retained for 7 years after final payment for audit purposes
We may retain certain information longer if required by law, regulation, or legitimate business interests such as ongoing legal proceedings or unresolved royalty claims.

11. Children's Privacy
Our Services are intended for users 18 years of age and older. We do not knowingly collect information from children under 18. If we discover such collection, we will promptly delete the information and terminate the account.

California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):
California residents have additional rights including the right to know about personal information collection and sharing, delete personal information, correct inaccurate information, and opt out of the sale or sharing of personal information.
